Acceptance of Terms

By accessing or using Charstory ("Lore Chat," "the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service ("Users").

Description of the Service

Charstory is an encrypted character chat application that enables users to:

  • Create and manage AI chat characters with detailed backstories and lore
  • Engage in roleplaying conversations powered by configurable AI models
  • Create and manage user personas for roleplaying
  • Store and synchronize encrypted chat history, character data, and lore
  • Manage account settings

The Service employs client-side AES-GCM encryption to protect user-generated content. All messages, character definitions, lore entries, and persona data are encrypted before transmission and storage.

Eligibility

By using the Service, you represent and warrant that:

  • You are at least 13 years of age (or the age of digital consent in your country of residence)
  • You have the full power and authority to enter into these Terms
  • You are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country
  • You are not listed on any U.S. government list of prohibited or restricted parties

Account Registration and Security
Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed.

Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Account Suspension

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete, or if you violate these Terms.

Acceptable Use
Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Conduct

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any applicable laws or regulations
  • Attempt to circumvent encryption or access data you are not authorized to access
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Introduce malicious code, viruses, or any other harmful material
  • Use the Service to generate, store, or transmit content that is illegal, hateful, harassing, defamatory, or otherwise objectionable
  • Create sexually explicit or graphically violent content involving minors
  • Create, request, upload, clone, or use any voice, likeness, or style intended to imitate a real person without authorization, including celebrity voices, private individuals, or prompts such as "sounds exactly like" a specific real person
  • Create unauthorized impressions, impersonations, or simulations of real people that are intended to deceive, confuse, or falsely imply endorsement, affiliation, identity, or authorship
  • Create, request, or engage in sexual or sexually suggestive roleplay presented as involving a real person
  • Create, request, or sexualize any character under 18, any minor-coded fictional character, or any age-ambiguous character presented as "barely legal" or otherwise near-minor
  • Create, request, or sexualize content that uses school-age framing, age regression, de-aging, "make them younger" instructions, or any similar framing that presents a character as younger, youthful, or minor-coded for sexual purposes
  • Impersonate any person or entity, or falsely state your affiliation
  • Use any automated means (bots, scrapers, etc.) to access or interact with the Service without our express permission
  • Attempt to bypass any security measures or access restrictions
Content Standards

You are solely responsible for the characters, personas, messages, lore, and all other content you create or transmit using the Service. You retain all responsibility for ensuring your content complies with applicable laws and these Terms.

For clarity, Charstory prohibits attempts to evade these rules through disclaimers, relabeling, fictionalization, or contradictory prompt claims. If content is reasonably presented as involving a real person, a minor, a minor-coded character, or an unauthorized voice or likeness imitation, it is prohibited even if the prompt claims otherwise.

Intellectual Property Rights
Our Rights

The Service, including its code, design, layout, graphics, and underlying technology (excluding user-generated content), is owned by Charstory and is protected by copyright, trademark, and other intellectual property laws.

Your Rights

You retain all ownership and intellectual property rights to the content you create using the Service (character definitions, personas, lore, messages). We claim no ownership over your user-generated content.

License to Us

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing the Service to you. This license does not grant us the right to use your content for any other purpose without your consent.

Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

  • Your chat content, character data, lore, and personas are encrypted client-side using AES-GCM encryption
  • We cannot read your encrypted content
  • We do not sell your personal information
  • Your data is stored locally and may be synced for backup and multi-device access

Aggregated Anonymous Data for Marketing Promotion
Data Aggregation

We reserve the right to collect, aggregate, and anonymize usage data to produce statistical information about how the Service is used, including for marketing and promotional purposes. This aggregation process strips all personally identifiable information.

Permitted Uses

We reserve the right to use such aggregated anonymous data for:

  • Marketing and Promotion: Publishing aggregate statistics for marketing campaigns, promotional materials, case studies, investor presentations, and public communications.
  • Product Improvement: Analyzing usage patterns to improve features, performance, and user experience.
  • Reporting: Internal and external reporting on platform growth, engagement, and operational metrics.
Opt-Out

You may opt out of contributing to aggregated anonymous data by adjusting your privacy settings within the Service. Opting out will not affect your ability to use core features of the Service.

Subscriptions and Payments
  • Paid Plans: Certain features may require a paid subscription. Subscription fees, billing cycles, and plan features will be clearly presented at the time of purchase.
  • Payment Processing: If paid features are offered, payment terms and supported providers will be presented at the time of purchase. We do not store full credit card numbers.
  • Refund Policy: Refunds are handled in accordance with our refund policy as displayed during checkout or as required by applicable consumer law.
  • Fee Changes: We reserve the right to change subscription fees upon 30 days' notice. Continued use constitutes agreement to pay the modified fee.
  • Non-Payment: Failure to pay subscription fees may result in suspension or downgrade of your account.

Third-Party Services

The Service integrates with third-party services. We are not responsible for the content, privacy practices, or terms of third-party services.

  • Supabase — Authentication and database services
  • Cloudflare — Infrastructure and edge computing
  • AI Model Providers — Inference APIs as configured by users

Service Availability and Modifications
  • Availability: We strive to maintain high availability but do not guarantee uninterrupted or error-free operation.
  • Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
  • Updates: We may update these Terms from time to time. Material changes will be communicated via email or through the Service.

Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHARSTORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless Charstory, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or any content you create or transmit using the Service.

Termination
  • Termination by You: You may terminate your account at any time through the account settings or by contacting us.
  • Termination by Us: We may terminate or suspend your account immediately, without prior notice, if you violate these Terms.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease. Sections 6, 8, 12, 13, and 14 shall survive termination.

Governing Law and Dispute Resolution
  • Governing Law: These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions.
  • Dispute Resolution: Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
  • Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in any class-action lawsuit or class-wide arbitration.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Charstory regarding your use of the Service and supersede any prior agreements or understandings.

Severability, Waiver & Contact

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited to the minimum extent necessary so that the remaining Terms remain in full force and effect. No waiver of any term shall be deemed a further or continuing waiver.
